Terms and Conditions

These Terms and Conditions govern your use of the Therasize platform and website (the "Service"). By creating an account or using the Service, you agree to these terms. If you do not agree, please do not use the Service.

The Service is provided by Therasize Limited, a company registered in England and Wales (company number 14110293), with its registered office at Soho Works, 180 Strand, London WC2R 1EA ("Therasize", "we", "us"). You can contact us at contact@therasize.com.

Therasize is a platform that supports the work between a practitioner and the people they support, providing tools such as worksheets, assessments, scheduling, secure messaging and a resource library.

Therasize is a support tool for practitioners. It does not provide medical or clinical advice, does not diagnose, triage or make treatment decisions, and is not a substitute for professional care or judgement. It is not an emergency or crisis service. If you are in crisis or need urgent help, contact the emergency services on 999, NHS 111, or a crisis line such as the Samaritans on 116 123.

You must be 18 or over to create your own account directly with us. Where a practitioner or organisation provides therapy to a person under 18, that practitioner or organisation is responsible for the lawful basis, any necessary consent, and safeguarding, as described in our Privacy Notice.

You are responsible for keeping your account secure, including your password and any second factor, and for all activity that takes place under your account. Please give accurate information when you register and keep it up to date. Tell us promptly if you believe your account has been compromised.

Practitioners are responsible for their own professional practice, including their clinical judgement, the suitability of the Service for a given client, obtaining any consents they need, and meeting their safeguarding and professional obligations. Therasize does not provide or supervise care.

A connection between a practitioner and a client requires both to agree, and either can end it at any time. Where an organisation deploys Therasize to deliver a service, that organisation is the data controller for the care content, and Therasize acts as its processor, as set out in our Privacy Notice and any separate agreement.

You agree not to:

• use the Service for any unlawful purpose or in breach of these terms;
• share your login credentials or let anyone else use your account;
• upload content you do not have the right to share, or that is unlawful, harmful or infringing;
• attempt to gain unauthorised access to the Service, other accounts, or our systems;
• interfere with or disrupt the Service, or attempt to circumvent its security; or
• use the Service to build a competing product, or to scrape or extract data at scale.

You keep ownership of the content you put into the Service. You grant us a limited licence to host, store and process that content only as needed to provide and support the Service, and in line with our Privacy Notice. You are responsible for the content you provide and for having the right to provide it.

Some parts of the Service are paid. Prices and plan details are shown at the point of purchase. Payments are handled by our payment provider, Stripe; we do not store your full card details.

Paid plans renew automatically for the billing period you choose until cancelled. You can cancel at any time, and the cancellation takes effect at the end of the current billing period. Unless required by law or stated otherwise, fees already paid are non-refundable. We will give notice of any change to our prices.

We handle personal data in line with our Privacy Notice, which explains what we collect, how we use it, the legal bases we rely on, and your rights. For care content that a practitioner or organisation controls, that practitioner or organisation is the controller and Therasize acts as their processor.

Where you use the Service as a controller of personal data (for example, as a practitioner or organisation using Therasize to deliver care to your own clients), our Data Processing Agreement (DPA) applies to that processing and forms part of these terms. By accepting these terms, or by using the Service to process personal data as a controller, you agree to the DPA. If your organisation requires a separately signed data processing agreement, contact us at contact@therasize.com. Individuals who use the Service as clients or data subjects are not parties to the DPA; their data is protected by it and by our Privacy Notice.

The Service, including its software, design and content (other than your own content), belongs to Therasize or its licensors and is protected by intellectual property laws. These terms do not transfer any of those rights to you beyond the right to use the Service as permitted here.

We work to keep the Service available and reliable, but we provide it "as is" and do not guarantee that it will be uninterrupted or error-free. We may update, change or withdraw features from time to time, and will give reasonable notice of significant changes where we can.

The Service relies on trusted third-party providers, for example for hosting, payments and email, and may link to third-party sites. We are not responsible for third-party services or sites, and your use of them is subject to their own terms.

Nothing in these terms limits liability that cannot be limited by law, including for death or personal injury caused by negligence, or for fraud. Subject to that, we are not liable for loss that was not foreseeable, for loss arising from your own breach of these terms, or for clinical decisions, which remain the responsibility of the practitioner. Our total liability to you in connection with the Service is limited to the amount you paid us in the 12 months before the claim arose.

You can stop using the Service and delete your account at any time. We may suspend or end your access if you breach these terms or if we reasonably need to protect the Service or other users. On termination, we will handle your data in line with our Privacy Notice and any separate agreement, including returning or deleting it as agreed.

We may update these terms from time to time. Where a change is significant, we will give reasonable notice. Continuing to use the Service after a change means you accept the updated terms.

These terms are governed by the laws of England and Wales, and the courts of England and Wales have exclusive jurisdiction, except that if you are a consumer you may also have rights to bring proceedings in your own country.
